These General Terms and Conditions of Sale govern the rights and obligations of the parties in the context of online sales on the website biidry.club
PURCHASE
General Principle
Any purchase of an item on the website biirdy.club constitutes acceptance of these General Terms and Conditions of Sale by the Buyer.
The General Terms and Conditions of Sale are accessible on the website biirdy.club as well as during the order confirmation. The Buyer can review the General Terms and Conditions of Sale before clicking the checkbox titled “I have read and agree to the General Terms and Conditions of Sale without reservation.”
Confirmation and Conclusion of the Contract
Any successfully completed purchase is confirmed to the Buyer with a confirmation message and an order confirmation email.
The sales contract is considered concluded at the time of order confirmation by the Seller, which occurs after order validation and receipt of the purchase price. In all cases, the purchase price is due upon conclusion of the contract, that is, upon order confirmation by the seller. The seller may withhold delivery until payment is received. Exceptionally, the seller may, without waiving these general terms, authorize deferred payment.
By placing an order, the Buyer declares having the legal capacity to exercise civil rights.
Buyer’s Obligations
The Buyer agrees to provide valid contact information during the order and to pay the requested price.
The Seller assumes no responsibility for the inability to deliver ordered merchandise due to out-of-stock items, additional supply issues, production delays, or customs seizure.
The Seller remains free to remove or modify the products offered at its sole discretion and at any time.
PRICES
The prices listed in this catalog are guaranteed as net, VAT included, and are established in Swiss francs.
The indicated prices do not include shipping costs, which are charged additionally and vary according to the weight and size of the package.
Discount vouchers are not cumulative.
Delivery charges for all deliveries within Switzerland are indicated in the order summary.
Once the order is validated, its price can no longer be modified.
Items covered by a warranty are subject to the terms of the offer valid at the time of purchase. The warranty takes effect on the date of delivery, as evidenced by the accompanying document (invoice), which we request you to keep carefully. Not covered are damages due to poor maintenance, failure to follow instructions for use, or normal wear and tear.
Subject to the above, the Seller is authorized to modify, at its sole discretion and at any time, the price of the goods offered.
SHIPPING AND DELIVERY TIMES
The shipment of available items is made by post within 1 to 3 business days after receipt of full payment for the order, except in special cases. A contribution may be requested from you once per order.
IMPORTANT: Bi!rdy® does not deliver packages to PO boxes and does not deliver any merchandise to minors or customers under guardianship, except with written authorization from the parents or guardian.
Risk transfer—which includes the risk of loss as well as the deterioration of the merchandise—passes to the Buyer at the time of order confirmation by the Seller.
Any addressing errors or packages returned to us because they were not claimed, requiring a second shipment, will be charged a flat fee of CHF 20.00, covering the cost of a second shipment and related administrative fees.
RETURN OR EXCHANGE OF MERCHANDISE
Items must be returned intact and complete in their original packaging (with labels showing their references), accompanied by the delivery slip, within 7 days after receipt of your package, as evidenced by the postmark. Any opened or damaged package will not be accepted. Return shipping costs are your responsibility. In the case of an exchange order, shipping costs for your new order are free.
PAYMENT
Payment Methods: Visa, Mastercard, Twint, PostFinance (card), E-Finance (account), bank transfer, payment by payment slip. Payments are securely processed via our payment service provider Proxypay.
WARRANTY
The condition of the delivered goods must be checked within 2 business days of receipt to exclude material and manufacturing defects, as well as damage caused during transportation. According to the law, you are required to report any defects or irregularities affecting the delivered goods to us to allow us to address them.
For vacuum-packed merchandise, the Buyer is required to verify that the entire order is present BEFORE unsealing the transparent packaging. They must photograph the intact merchandise and send the photo(s) to us by email. Claims regarding opened packages will not be considered.
Photos of items on biirdy.club are not contractual.
DATA PROTECTION
Compliance with the provisions of the Swiss Data Protection Act and the relevant legal standards for the collection, processing, and use of personal data is guaranteed.
Data collected during the order process will only be used for internal purposes. The customer accepts this use of their data as part of the order process. Additionally, they always have the right to request information about the stored data and may prohibit its use for internal marketing purposes.
To exercise these rights, the user will contact customer service at info@biirdy.club, providing proof of identity with a copy of an identification document.
MODIFICATION OF THE GENERAL TERMS AND CONDITIONS
The Seller may modify these General Terms and Conditions of Sale. The version in force at the time of the order is binding in the contractual relationship between the Buyer and the Seller.
APPLICABLE LAW AND JURISDICTION
In the event of a dispute, the General Terms and Conditions in effect at the time of purchase shall serve as the legal basis.
The applicable law is Swiss law, and any dispute will be handled by the Wallisellen Court.
